Terms of Service

These Terms govern your use of the TrustTown mobile application and website operated by Shaiksaif (Sole Proprietorship). By creating an account or using TrustTown, you agree to these Terms. Please read them carefully.

1. Acceptance & Eligibility

By downloading, installing, or using the TrustTown application or website, you confirm that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into a binding contract under Indian law.
  • You will comply with these Terms and all applicable laws and regulations.

If you do not agree to these Terms, you must not use TrustTown. Use of the platform constitutes acceptance of these Terms and our Privacy Policy.

2. Description of Service

TrustTown is a technology platform that connects three types of users in Bangalore, India:

  • Customers — individuals who book home and local services.
  • Service Providers (Vendors) — verified professionals who fulfil service bookings.
  • Suppliers — businesses that supply materials and products to service providers.

Shaiksaif (Sole Proprietorship) acts as an intermediary technology platform and is not itself a party to the service contract between a Customer and a Service Provider. We do not employ Service Providers; they are independent contractors.

3. User Accounts

  • You must register with a valid Indian mobile number verified by OTP.
  • You are responsible for maintaining the confidentiality of your account and for all activity under it.
  • You must not create accounts using false information or impersonate another person.
  • You must promptly notify us at contact@trusttown.in of any unauthorised use of your account.
  • One person may not maintain multiple accounts without our prior written consent.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Customer Terms

4.1 Booking

  • When you submit a booking request, you are making an offer to engage the selected Service Provider.
  • A booking is confirmed when the Service Provider accepts and you receive a confirmation notification.
  • You must provide accurate service location details and ensure access for the Provider at the scheduled time.

4.2 48-Hour Redo Guarantee

If you are not satisfied with a completed service, you may request a redo within 48 hours of service completion. The redo is provided at no additional charge if the original work was completed as described. The guarantee does not cover damage caused by third parties, pre-existing conditions, or issues outside the scope of the original service.

4.3 Cancellations by Customers

  • Cancellations made more than 2 hours before the scheduled start time: full refund.
  • Cancellations made within 2 hours of the scheduled start time: a cancellation fee may apply.
  • No-shows (Provider arrives, Customer unavailable): the booking may be marked as completed and charged.

4.4 Conduct

Customers must treat Service Providers with respect. Abusive, threatening, or discriminatory behaviour towards Providers is grounds for immediate account suspension.

5. Service Provider (Vendor) Terms

5.1 Verification

  • Providers must complete identity verification (KYC) using a valid government-issued ID before accepting bookings.
  • Providing false KYC documents is a criminal offence under Indian law and will result in permanent account termination and reporting to authorities.

5.2 Service Standards

  • Providers must deliver services as described, on time, and to a professional standard.
  • Providers must carry all necessary tools, equipment, and licences required for the services they offer.
  • Providers must not misrepresent their skills, qualifications, or experience.

5.3 Independent Contractor Status

Providers are independent contractors, not employees of Shaiksaif (Sole Proprietorship). Providers are solely responsible for their own taxes, insurance, equipment, and compliance with applicable laws.

5.4 Commission & Payouts

  • Platform commission rates are displayed in the Provider dashboard and are subject to change with 30 days' notice.
  • Payouts are processed within the timeline specified in the Provider dashboard after service completion and confirmation.
  • We reserve the right to withhold payouts pending investigation of disputes or suspected fraud.

5.5 Cancellations by Providers

Providers who repeatedly cancel confirmed bookings may have their accounts suspended. A high cancellation rate negatively impacts your profile rating and visibility.

6. Supplier Terms

  • Suppliers must list accurate product descriptions, pricing, and availability.
  • Suppliers are responsible for the quality, safety, and timely fulfilment of orders placed through TrustTown.
  • Suppliers must hold all required business licences and comply with applicable goods and tax regulations (GST).
  • Commission rates and payout terms for Suppliers are specified separately in the Supplier agreement.

7. Bookings & Payments

7.1 How Payments Work

TrustTown does not process, hold, or facilitate payments. All payments for services and products are made directly between the Customer and the Service Provider or Supplier, on terms agreed between them. Shaiksaif (Sole Proprietorship) is not a party to any payment transaction and accepts no responsibility for payment disputes, non-payment, or failed transactions.

Customers and Providers/Suppliers are free to agree on their own payment method (cash, UPI, bank transfer, etc.). TrustTown makes no representation about the suitability or safety of any payment method chosen by users.

7.2 Pricing

Service prices displayed on the platform are indicative and set by the Service Provider. Final pricing is agreed between the Customer and the Provider before or at the time of service delivery. Shaiksaif (Sole Proprietorship) is not responsible for pricing disputes.

7.3 Disputes

Payment disputes and refund claims are solely between the Customer and the Service Provider or Supplier. Shaiksaif (Sole Proprietorship) may, at its sole discretion, facilitate communication between parties to help resolve disputes, but is under no obligation to do so and is not liable for any outcome.

Service quality disputes (e.g., a redo request under the 48-hour guarantee) can be raised through the in-app dispute flow within 48 hours of service completion. Shaiksaif (Sole Proprietorship) will facilitate communication but the resolution is between the Customer and Provider.

7.4 Taxes

Each party is independently responsible for their own tax obligations. Service Providers and Suppliers are responsible for GST compliance on their services and products.

8. Prohibited Conduct

You must not:

  • Use the platform for any unlawful purpose or in violation of any Indian law or regulation.
  • Arrange or accept payments for services booked through TrustTown outside the platform (off-platform transactions).
  • Post false, misleading, or fraudulent reviews or ratings.
  • Harass, abuse, threaten, or discriminate against other users.
  • Attempt to circumvent platform security, reverse-engineer the app, or scrape data.
  • Use automated scripts, bots, or other means to interact with the platform.
  • Impersonate another user or Shaiksaif (Sole Proprietorship) staff.
  • Upload or transmit viruses, malware, or any malicious code.

Violation of these prohibitions may result in immediate account suspension and legal action.

9. Intellectual Property

The TrustTown name, logo, platform design, code, and content are the intellectual property ofShaiksaif (Sole Proprietorship) and are protected under Indian copyright, trademark, and other IP laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

By submitting reviews, photos, or other content on the platform, you grant Shaiksaif (Sole Proprietorship) a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content in connection with operating and promoting the platform.

10. Disclaimers & Limitation of Liability

10.1 Platform Disclaimer

TrustTown provides a technology platform to connect users. We do not guarantee the quality, safety, or legality of services offered by Providers or products offered by Suppliers. We are not liable for the acts or omissions of Providers, Suppliers, or Customers.

10.2 Limitation of Liability

To the maximum extent permitted by applicable law, Shaiksaif (Sole Proprietorship)'s total liability to you for any claim arising out of or in connection with these Terms or your use of the platform shall not exceed the amount you paid to us in the 3 months preceding the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

10.3 Force Majeure

We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, power failures, internet outages, or government actions.

11. Indemnification

You agree to indemnify and hold harmless Shaiksaif (Sole Proprietorship), its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any service you provide or receive through the platform.

12. Termination

You may delete your account at any time through app settings. We may suspend or terminate your access to the platform at any time, with or without notice, for:

  • Violation of these Terms or our policies.
  • Fraudulent, abusive, or illegal activity.
  • Repeated low ratings or unresolved customer complaints.
  • Providing false KYC or identity information.

Upon termination, pending payouts to Providers may be held for up to 60 days pending resolution of any outstanding disputes.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.

Consumer disputes may also be raised with the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via in-app notification or email at least 15 days before the changes take effect. Your continued use of the platform after the effective date constitutes acceptance of the revised Terms. If you disagree, you may close your account before the effective date.
